Common questions relating to Teignmouth Lease Extensions

  • I am a FTB of a leasehold flat in Teignmouth. The lease has just 75 years left and ground rent is £50. Is it possible for the vendor to serve the Notice of Claim and then assign this right to me as the buyer on the day of completion so that I can avoid waiting for the two year requisite period before I can apply to for a lease extension or have to deal with all this expense later? I have read this is legal but will it be very time costly to the vendor? Unfortunately the freeholder can not be found, so I am not sure how does it work.
  • I have my suspicions that my niece might have had the wool pulled over her eyes. She put in an offer on a garden flat in Teignmouth, where the lease is slightly less sixety four years but she was informed by the estate agents that the seller had extended it to 125 years. She has now been told the vendor was holding off for her to retain conveyancers ahead of instigating the lease extension. Seems devious, also it will take a while to sort it all out. Am I being too sceptical?
  • My mortgage provider is requesting several hundred pounds for their lawyers for a "deed of substituted security" for the lease extension for my flat in Teignmouth... I can find no mention of this in my mortgage contract... is this a normal cost that they charge?
  • Offer accepted on a a garden flat in Teignmouth, were told numerous times by the EA that the lease was in excess of 100 years, we have just had our mortgage offer in writing through the post which states the lease as eighty years.Contracts were due to be exchanged within a week. My query is Should I tell the vendor that I will only proceed with the purchase (at the same price) on the condition they carry out a lease extension?
  • I am looking to buy a one bed flat in Teignmouth for asking price of 156k, which has 78 years lease left on it. I appreciate that ideally, the seller would start the process by serving a section 42 notice to start the lease extension process but the seller is refusing to assist. My query is: If the freeholder does not agree to a marriage value (part of lease extension fees) of surveyor, how lengthy and difficult is the process of going down the route of Leasehold Valuation Tribunal?
  • We are purchasing a one bed flat in Teignmouth which has share of freehold and a leasehold. The lease was starting to get low so the seller is in the process of dealing with a lease extension. The owner has submitted the lease extension paperwork to HMLR. A crucial aspect of the house buying process is for our solicitors to do OS1 search on the lease. The concern here is that as a lease extension has been submitted we've been told by our property lawyers it may not be possible to do this "priority search" right now as the new property title number has not been issued. Is it correct that we have to wait until the new lease is registered?
  • Hopefully an easy question for you, how much does it cost for a lease extension on a residential property in Teignmouth for a three bed flat - sec 42 having been issued?
  • I'm seeking some assistance with regard to a lease extension on my apartment. I'll be looking to do this in six months time as we need to move then. Unfortunately the current lease is now very short and therefore I'm guessing it'll be expensive to extend. I'm also thinking that I'll probably have to go down the LVT route. Can you recommend a good conveyancers with expertise in lease extensions. Ideally someone in Teignmouth area?
  • My wife and I are aware that others in the same block had already had a lease extension, and the landlord was amenable. It therefore appears worth taking risk of not having formal survey and base the initial offer on on the prices by others . This would save on double valuation charges. Would you recommend this course of action?
