Frequently asked questions relating to Rhoose Lease Extensions

  • We have seen a house for sale for £195k and we are very interested but we've just discovered that it is leasehold. There are 899 years remaining so a lease extension is not a concern. We didn't know what this meant but the internet suggests we wouldn't own the land or property, just the lease to live there. Is this true? We wouldn't want to pay a mortgage for 25 years without the house being ours. Any suggestions would be much appreciated.
  • Hello. I need someone to have a look at my lease extension prior to it being completed just to ensure there's nothing that I haven't seen - it's just a reissue with a few small amendments.
  • I have contacted my freeholder for a lease extension for my flat in Rhoose. Her conveyancers has been in contact with fees etc. I need a ball park figure for dealing with the legalities to secure a lease extension. The property currently has a 99 YR lease which started December 1994.
  • I purchased a garden flat in Rhoose. The lease started in 1998 for 99 years. Now I am looking to extend the lease. I am in the dark about additional expenses, could you tell me please how much I should expect to spend on this?
  • I will soon view a two bedroom apartment, although not exactly my ideal property it has enough positives to suit me very well for my present circumstances. However after obtaining a copy of the title I've learnt that it only has sixety four years residual lease term on the lease. It is also a repossession so I'm assuming that the bank will not be interested in extending the lease. My primary concern is would the short lease make it difficult to secure a mortgage?
  • I am a FTB of a leasehold flat in Rhoose. The lease has only 77 years residual lease term and ground rent is £95. Is it possible for the seller to serve the Section 42 Notice and then transfer this right to me as the buyer once I complete the buying process so that I don't have to wait for the two year qualifying period before I can apply to for a lease extension or have to deal with all this expense later? I have read this is legal but will it be very time consuming to the seller? Unfortunately it’s the case of an absent landlord, so I am not sure how this will play out.
  • I intend to buy a one bed flat in Rhoose for asking price of 145k, which has 54 years lease left on it. I appreciate that ideally, the seller would start the process by serving a section 42 notice to start the lease extension process but the seller is refusing to assist. My question is: If the freeholder does not agree to a marriage value (part of lease extension fees) of surveyor, how lengthy and easy is the process of going down the route of Leasehold Valuation Tribunal?
  • I would like some help on leasehold property buying. We are going to buy a link detached house which is leasehold property is there any problem involved or hidden costs. What are the downsides of purchasing a leasehold house in Rhoose area with a loft extension..We are really concerned as we are first time buyers...Please advise if we want to let the property?
  • My father has a share of freehold, with two other leaseholders in a building in Rhoose. House divided into three apartments. He has a lease, which has nearly 67 yrs left. Does he have to do the lease extension at the same time with the other tenants, or could he extend the lease on his own?
  • Me and my sister are acquiring a studio flat in Rhoose which has share of freehold and a leasehold. The lease was on the short side so the vendor is in the process of extending the lease. The vendor has submitted the lease extension paperwork which will result in the registration of a new lease at the land registry. An essential part of the conveyancing process is for our property lawyers to do a "priority search" on the lease. The concern here is that as a lease extension has been submitted we've been told by our conveyancing practitioners it may not be possible to do this "priority search" right now as the new lease title number is not known. Is it correct that we must be patient until the new lease is registered?
