Frequently asked questions relating to Midhurst Lease Extensions

  • I need to negotiate a lease extension for a flat in Midhurst and want to use a local solicitors. Is there a solicitors that you can recommend?
  • We have seen a house for sale for £195k and we are very interested but we've just discovered that it is leasehold. There are 899 years residual lease term so a lease extension is not required. We didn't know what this meant but the internet suggests we wouldn't own the land or property, just the lease to live there. Is this true? We wouldn't want to pay a mortgage for 25 years without owning the property. Any guidance would be much appreciated.
  • I have a lease of sixety nine years on a property which I am looking to buy how much am I looking at for the cost to extend the lease?
  • This flat I have in mind requires only ground rent. Long lease so no lease extension required. I have asked the estate agents as to what happens to building insurance and responsibility for communal areas and if one of the two flats which make up the property wants to make alterations. They said they did not know. I cannot see how one could get buildings insurance for the whole building shared with another flat, either downstairs or upstairs. I do need to clarify things like this before I undertake all the expenses involved in purchasing a property I feel. Do freeholders actually supply their own insurance?
  • I am a first time buyer of a leasehold flat in Midhurst. The lease has just 69 years left and ground rent is £95. Is it possible for the seller to serve the Section 42 Notice and then assign this right to me as the buyer once I complete the buying process so that I can avoid waiting for the 2 year requisite period before I can apply to for a lease extension or have to deal with all this expense later? I have read this is achievable but will it be very time consuming to the homeowner? Unfortunately it’s the case of an missing landlord, so I am not sure how does it work.
  • I intend to buy a one bed flat in Midhurst for asking price of 125k, which has 71 years lease left on it. I appreciate that ideally, the seller would start the process by serving a section 42 notice to start the lease extension process but the seller is refusing to assist. My query is: If landlord does not agree to a marriage value (part of lease extension fees) of a valuer, how lengthy and easy is the process of going down the route of Leasehold Valuation Tribunal?
  • My wife and I have owned a leasehold flat for about eighteen years. There are 67 years remaining on the lease. After a year of difficult negotiations through my lawyers and, mainly, surveyor I now have an offer from the freeholder. I now have to make a decision as to whether to accept it or go to a Tribunal and would welcome advice.
  • I'm living with my mother and father but have a maisonette in Midhurst let out which has a sixety two year lease. Mortgage broker said I can remortgage as a buy to let instead of consent to let and release 55-60k which on top of a new mortgage based on my income. Not much about in Midhurst for me to get my own place. If I sell I will only get 150-160 due to tenant (8 months left on AST) and lease. A lease extension will cost 19k. Not sure sure whether to hold on or sell the flat?
  • I do not need a lease extension but I do require a vesting order on a property I want to buy in Midhurst. The house is freehold but the garden is officially leasehold, Nine hundred and ninety nine year lease from 1854. Its the garden area.
  • I was hoping you might be able to tell me the process of how to apply for a lease extension for my one bedroom apartment in Midhurst
