I am a FTB of a leasehold flat in Elmstead. The lease has just 70 years balance left and ground rent is £50. Is it possible for the current owner to serve the Initial Notice and then transfer over the right to me as the purchaser on the day of completion so that I don't have to wait for the two year qualifying period before I can apply to for a lease extension or have to deal with all this expense later? I have read this may be possible but will it be very time costly to the seller? To add to the complexity it’s the case of an missing landlord, so I am not sure how this will play out.

My partner and I had entered into a purchase of a studio flat in Elmstead. I was advised by the EA that the lease extension had already been completed while on a viewing (sixety four years remaining prior to extension). The sales particulars said "sold with a long lease". It transpires as we are about to exchange of contracts we find that the lease has not been extended. The seller supposedly has a quote but no finances to extend and consequently the current owner wishes to exchange and use the 10% deposit to extend the lease. My question is as the lease hasn't been extended is there not a danger that it would breach my lenders lease length criteria?
