FAQs concerning Clerkenwell Lease Extensions

  • I'm intending to make an offer on a house in Clerkenwell but I'm a little worried about it being leasehold. Do you know what title absolute means and is this regarding the lease? Also, we have asked to see a copy of the lease but the homeowner said they might not have it. We are worried about restrictions, and dont know what to do. We have also been approved for the mortgage but the lender doesn't know its leasehold. Do houses qualify for lease extension? Will this affect Nationwide Building Society giving us the mortgage now?

  • I'm looking for an apartment to buy in Clerkenwell and I'm not really familiar with the leasehold concept. I've found a three bed flat I like with a 82 years lease. I've read that I can get a lease extension after a couple of years, but:- Should I be looking at some caveats that would prevent me for getting a lease extension?
  • I am about to view a one bedroom flat, although not exactly my perfect property it has enough positives to suit me very well for my present circumstances. However after obtaining a copy of the title I've learnt that it only has 61 years left on the lease. It is also a repossession so I'm guessing that the vendor will not be interested in extending the lease. My main concern is would it be difficult to sell on without a lease extension?
  • My husband and I have owned a leasehold flat for approximately eighteen years. There are 67 years outstanding on the lease. Following a year of protracted negotiations through my and, mainly, surveyor I now have an offer from the landlord. I now have to make a decision as to whether to accept it or go to LVT and would appreciate some independent thoughts.

  • Me and my husband are purchasing a garden flat in Clerkenwell which has share of freehold and a leasehold. The lease was on the short side so the vendor is in the process of dealing with a lease extension. The seller’s lawyer has submitted the lease extension paperwork which will result in the registration of a new lease at the land registry. A crucial aspect of the conveyancing process is for our to do a pre-completion search on the property title. The concern here is that as a lease extension has been submitted we've been told by our it may not be possible to do this "priority search" right now as the new lease title number has not been issued. Is it correct that we have to wait until the new lease is registered?
  • We are concerned about seeking a lease extension from tricky landlord. Even though the correct procedures were adhered to under the 1993 Act, the freeholder still tried to charge ground rent of £300 doubling every 25 years of the new lease. Can you assist?
  • I have a lease of 65 years remaining on my flat in Clerkenwell. We are looking for a lease extension, so we contacted our freehold company and they came back with a quote that was double the amount and half the extension time that the lease extension calculator provided. Is there anyway, without racking up a huge legal bill, we can ask the freehold company to provide their computation of the amount and how they derived to it?
