Questions and Answers: Chester Lease Extensions

  • We have seen a house for sale for £195k and we are very interested but we've just found out that it is leasehold. There are 798 years outstanding so a lease extension is not required. We didn't know what this meant but the internet suggests we wouldn't own the land or property, just the lease to live there. Is this true? We wouldn't want to pay a mortgage for twenty years without owning the property. Any guidance would be much appreciated.

  • We have a ground floor flat in Chester with sixety four years unexpired. Last year we were quoted a deal to receive a lease extension for another thirty years but also uplift the ground rent from nominal to a little more..plus a premium I think of about 10k. We have now decided to proceed but do we now have to start the negotiations again?
  • We had entered into buying a three bed flat in Chester. I was told that the lease had been extended (sixety years left prior to extension). The description on the listing said "sold with a long lease". It turns out at the point of exchange of contracts we find that there has been no lease extension. The flat owner apparently has a quote but no money to extend and consequently the vendor wants to exchange and use the 10% deposit for the lease extension. My question is is it not odd that my lawyers didn't spot this far earlier than just before exchange?
  • I intend to buy a one bed flat in Chester for asking price of 156k, which has seventy five years lease left on it. I appreciate that ideally, the seller would start the process by serving a section 42 notice to start the lease extension process but the seller is refusing to assist. My query is: If the freeholder does not agree to a marriage value (part of lease extension fees) of surveyor, how lengthy and easy is the process of going down the route of Leasehold Valuation Tribunal?
  • I am in need of some help with a lease extension. I live in Edinburgh but the flat in question is based in Chester. I would be grateful if you can give me a call when you get a chance to discuss the case.
  • If a leaseholder owns a flat with a lease of less than 80 years, they can afford the lease extension by borrowing the funds against the property, and the value of the flat with the new lease will more than cover the cost of the extension, then is there any justification for not doing it?
  • I know that others in the same building had already had a lease extension, and the landlord seemed reasonable. It therefore appears worth taking risk of avoiding a formal valuation and calculate the initial offer on previous prices . This would save on double valuation charges. Would you recommend this course of action?
