Questions and Answers: Bilston Lease Extensions

  • I'm planning to make an offer on a house in Bilston but I'm a little worried about it being leasehold. Do you know what title absolute means and is this regarding the lease? Also, we have asked to see a copy of the lease but the homeowner said they might not have it. We are worried about restrictions, and dont know what to do. We have also been approved for the mortgage but the lender doesn't know its leasehold. Do houses qualify for lease extension? Will this affect Platform Home Loans Ltd giving us the mortgage now?
  • I want to purchase a leasehold property and extend the lease. The seller has been there over 2 years and will sign the notice. He will let me have the notice on exchange and then I will serve it in the landlord. Is this OK ?
  • I invested in buying a two bedroom first floor purpose built maisonette in Bilston. The lease commenced in 1991 for 99 years. Now I am looking for a lease extension. I am not entirely sure about further expenses, could you tell me please how much I should expect to spend on this?
  • I am looking to either purchase the freehold or a lease extension of my property in Bilston and have been in touch with the freeholder, have had quote for around £3k to extend the lease. I plan to simultaneously refinance with Barclays Direct to free up equity. The adviser handling the remortgage suggested I get two estimates : one to extend the lease and one for outright purchase .The lease began in 1991 and since then the ground rent has increased from £15.00 per annum to £100 per annum.
  • I am a first time buyer of a leasehold flat in Bilston. The lease has just seventy eight years remaining and ground rent is £75. Is it possible for the flat owner to serve the Section 42 Notice and then assign this right to me as the purchaser on the day of completion so that I don't have to wait for the 2 year qualifying period before I can apply to for a lease extension or have to deal with all this expense later? I have read this may be possible but will it be very time consuming to the vendor? Unfortunately the freeholder is absent, so I am not sure how does it work.
  • I am a landlord of a block of flats in Bilston, and the lessees are in the process of being given lease extensions. I should hopefully get funds next week. How does the tax work, the property is in joint names with my wife ?
  • My solicitors (separately handling my lease extension) said I need a licence to alter given that I wish to carry out a loft extension to my property. Is this strictly required given that I have a share of the freehold. I've informally discussed the loft conversion with my co-freeholder some time ago and he had no objection once I reassured him that if my builder damages the roof I won't expect the co-freeholder to pay for future repairs to the roof. Assuming I need formal consent should I get the licence to alter and then start the lease extension process?
  • I am the freeholder of a 1930’s property split into two flats. I live in the upper flat and my neighbour in the lower flat. My neighbour has approached me for a lease extension from the current seventy eight years. What are my next steps?
  • I own the freehold reversion of a property in Bilston and a leaseholder would like a lease extension. Her so called valuation expert has given a figure of £9,000, but has upped this by £2,000 at the drop of a hat. My valuer has come back with £12,520. Negotiations have broken down so it looks at though we need to go to a FTT. If a lease extension does go to tribunal, can I deal with this myself, just armed with the valuations I have? If not, what costs would I be likely to face?
